Part I: Evidentiary Rulings on the Admissibility of Expert Evidence (1 hour)

This program will offer a comprehensive review of several published decisions that define and provide clarity on the topic of admissibility relating to expert evidence at trial. In accordance with the Mohan Principles, admission of expert evidence requires: (a) that it be relevant to the issues; (b) that it be necessary in assisting the trier of fact; (c) the absence of any exclusionary rule; and (d) a properly qualified expert. Our program will discuss the following:
- Key principles of admissibility.
- Why portions of reports, or reports in their entirety are deemed inadmissible
- Common legal arguments of admissibility.
Part II: Medical Report Writing, Practical Tips from the Trenches (1.25 hours)
